Swiss law (CO) does not provide a statutory right of withdrawal for online purchases. The return option described below is a voluntary goodwill service of Badertscher Tool AG.
It does not constitute a legal entitlement and may be restricted or withdrawn at any time.
1. Our Voluntary Right of Return
Badertscher Tool AG grants private customers the right to return stock items without giving reasons within 8 days of receiving the goods.
The return can be declared in the following ways:

- By returning the goods within the deadline — at the customer's risk and expense

Please ensure the parcel is sufficiently franked. Unfranked consignments will not be accepted.
3. Condition of Returned Goods
You may inspect the goods before returning them — as would have been possible in a shop. Use beyond this constitutes usage and entitles Badertscher Tool AG to deduct an appropriate reduction in value.
For a full refund, the goods must meet the following conditions:
- Unused, unworn, unwashed and free of signs of use
- In original packaging with intact original labels
- Complete (incl. accessories, inserts and documentation)
- A regular stock item (no special item or special order)
For damaged, worn or incomplete goods, Badertscher Tool AG reserves the right to deduct the reduction in value.
4. Items Excluded from Return
- Custom-made items and items manufactured to customer specifications (special sizes, Flexi-Color, etc.)
- Printed, embroidered or otherwise personalised items
- Underwear, thermal underwear, t-shirts, shirts, socks and similar hygiene items
- Items from special sales and end-of-line articles
- Already worn, used or washed goods
- Audio/video recordings and software with unsealed data carriers
- Newspapers, magazines and periodicals
- Perishable goods or items past their expiry date
5. Refund
After receipt and inspection, Badertscher Tool AG will refund the purchase price within a reasonable period using the same payment method.
Original shipping costs and return shipping costs will not be refunded.
6. Relationship to GTC and Statutory Warranty
This voluntary right of return supplements the GTC. Statutory warranty rights under the CO (Art. 197 ff.) remain unaffected.
In case of conflicts, the GTC prevail unless the right of return contains a more favourable provision for the customer.
7. Legal Basis
The statutory warranty is governed by the Swiss Code of Obligations (CO), in particular Art. 197–210 CO.
Badertscher Tool AG distinguishes between private customers (consumers) and commercial customers (B2B).

9. Warranty for Private Customers
- Warranty period: 2 years from delivery (Art. 210 para. 1 CO) — cannot be reduced.
- Reversal of burden of proof: If a defect appears within 6 months, it is presumed to have existed at delivery.
- Duty to notify: Report defects in writing within a reasonable time after discovery.
- Rights: Repair or replacement; if unsuccessful: reduction or rescission.
10. Warranty for Commercial Customers (B2B)
- Warranty period: 1 year from delivery (contractually reduced per Art. 210 CO).
- Immediate duty to notify (Art. 201 CO): Inspect immediately on receipt, report defects in writing. Late notification = loss of warranty rights.
- Rights: Repair or replacement at Badertscher Tool AG's discretion. After two failures: reduction or rescission.
- Burden of proof: Buyer must prove defect existed at delivery.
11. Manufacturer's Guarantee
- The manufacturer's guarantee (e.g. Milwaukee, Hultafors, Snickers Workwear) is granted directly by the manufacturer.
- It supplements the statutory warranty and does not restrict it.
- Claims can be made directly with the manufacturer or via Badertscher Tool AG.
- Scope and duration are set out in the guarantee documents or on the manufacturer's website.
